An important message from Tropical Sun
Following action by the Australian Competition and Consumer Commission (ACCC), the Federal Court of Australia has declared that Tropical Sun Industries Pty Ltd (Tropical Sun) contravened the Trade Practices Act 1974 (the TPA) by engaging in false, misleading and deceptive conduct*. Tropical Sun engaged in the offending conduct in the course of carrying on and promoting its solarium tanning business.
The ACCC's action against Tropical Sun was taken in conjunction with proceedings against Body Bronze International Pty Ltd (Body Bronze), the Australian Tanning Association (ATA) and Mr Scott Meneilly, the former President of the ATA and the former Chief Executive Officer of Body Bronze.
The offending representations were made by Tropical Sun at certain times between October 2007 and June 2008:

> on the website www.tanningtruth.com (which statements Tropical Sun adopted and published);
> in a media release distributed to 1,125 of Tropical Sun customers on, or about 1 October 2007, and
> in relation to Tropical Sun's customer "Skin Type Analysis" Forms.
The court declared that Tropical Sun's conduct contravened the TPA because it represented that:
- The tanning process does not involve damage to the skin (when in fact damage to the skin DNA is required to induce the tanning process);
- Tanning protects the skin against sunburn and from the risks of sunburn (when in fact tanning does not materially protect the skin from sunburn nor the risks associated with sunburn);
- Tanning protects the skin against ultraviolet light and from the risks of ultraviolet light exposure (when in fact tanning does not materially protect the skin from ultraviolet light exposure nor the risks of ultraviolet light exposure);
- The body repairs any damage to the skin caused by ultraviolet light exposure (when in fact some skin damage caused by ultraviolet light exposure may not be repaired by the body's skin repair mechanisms);
- The skin is not damaged by ultraviolet light exposure unless it receives a sunburn (when in fact damage to the body caused by ultraviolet light exposure occurs without sunburn), and
- Tropical Sun's customer Skin Type Analysis Form and Website Skin Type Analysis Form can be used to assess accurately a person's Skin Type in order to ascertain the person's tanning and burning ability (when in fact such a form or questionnaire cannot assess accurately a person's Skin Type and predict his or her response to ultraviolet light exposure).
As part of its orders, the Court restrained Tropical Sun from engaging in similar conduct for a period of 3 years and required it to publish this notice, implement a trade practices compliance program and pay the ACCC's costs of the proceeding.
The court made similar declarations and orders for relief against Body Bronze and Tropical Sun for engaging in false, misleading and deceptive conduct in contravention of the TPA. Related declarations and orders were also made against the ATA and Mr Meneily.
*Specifically, the Court declared that Tropical Sun contravened sections 52,53(aa), 53(c) and 55A of the TPA. Section 52 of the TPA prohibits conduct that is misleading or deceptive or is likely to mislead or deceive while section 53 prohibits the making of certain false representations about goods and services. Section 55A prohibits conduct liable to mislead the public as to the nature, the characteristics and the suitability for their purpose of services.
